Your Obligations

    Keep your WEBRUS account login information safe.

    Provide us with up-to-date, accurate, and valid personal information.

    You own the rights to any content uploaded by you on your website.

Third Party Services

WEBRUS are remunerated by Barclaycard for successful introductions that result in Barclaycard Payment Solutions providing merchant acquiring or gateway solutions to a merchant.

User Content

The sites created using WEBRUS may contain user content that violates the permitted usage of the platform. We do not endorse or support such content. We're not liable for any user content uploaded via the services.

What We Provide and Our Rights

WEBRUS provides a website and funnel building system, templates, email marketing, and automations, appointment scheduling, website hosting, and domain registration. We reserve the right to change parts or all of the services and functionalities at any time.

Trial Subscription

WEBRUS provides a 14-day trial to all newly created websites. After the trial period, the website will become non-active until you subscribe to the paid services. We have the right to terminate or cancel trial subscriptions at any time.

Service Fees

Service fees are applicable upon signing up for the paid services of WEBRUS, which can be monthly or yearly. All fees are in USD and exclusive of taxes. Refunds are allowed only for yearly subscriptions and up to 14 days after the subscription is made.

Service Cancellation

Failure to comply with any of WEBRUS’s terms or pay due fees may result in the cancellation or suspension of your account services and website. You can cancel your services at any time, no questions asked. We are not responsible for any damages and losses due to the cancellation of services.

Termination

We reserve the right to change, suspend, or terminate your use of the services at any time without notice. If you violate the terms of this agreement, it may result in immediate termination of your account without a refund.

Domains

With a yearly subscription, you have the right to claim a free custom domain for the first year. All domains are provided by third-party companies partnering with us. By claiming a domain, you agree to the domain register company’s terms and conditions.

Warranty and Disclaimer

WEBRUS strives to maintain the services in a manner that minimizes errors and interruptions. However, we do not warrant that the services will be uninterrupted or error-free.

Indemnity

You agree to indemnify and hold harmless WEBRUS and its affiliates from any claims arising out of or related to your use of the services or your violation of this agreement.

Limitation of Liability

To the fullest extent permitted by law, WEBRUS and its affiliates will not be liable for any indirect, special, incidental, or consequential damages arising out of or related to the services or this agreement.

Modifications

WEBRUS may make modifications and changes to the services and fees at any time. You will be notified of any changes prior to their implementation.

Miscellaneous

If any provision of this agreement is found to be unenforceable, the remaining provisions will remain in full force and effect. This agreement is the complete and exclusive statement of the mutual understanding of the parties and supersedes all previous agreements relating to the subject matter.

      All trade names, trademarks, and images and biographical information of people used in the Company Content and contained in the Site, including without limitation the name and trademark “WEBRUS”, are either the property of, or used with permission by, the Company. The use of Content by you is strictly prohibited unless specifically permitted by these Terms of Use. Any unauthorized use of Content may violate the copyright, trademark, and other proprietary rights of the Company and/or third parties, as well as the laws of privacy and publicity, and other regulations and statutes. Nothing contained in this Agreement or in the Site shall be construed as granting, by implication or otherwise, any license or right to use any Trademark or other proprietary information without the express written consent of the Company or third party owner. The Company respects the copyright, trademark and all other intellectual property rights of others.

At WEBRUS, we are committed to providing high-quality web design and digital services that align with our ethical standards and values. To maintain the integrity of our work and respect the diverse perspectives of our global audience, we have established clear content and service limitations. Accordingly, we reserve the right to decline projects or terminate services that involve the following types of content:

    The Company has the right, but has no obligation, to remove content and accounts containing materials that it deems, in its sole discretion, to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Use. If you believe that your intellectual property rights are being violated and/or that any work belonging to you has been reproduced on the Site or in any Content in any way, you may notify Company at www.web.us/contact. WEBRUS RESERVES THE RIGHT TO DETERMINE, IN ITS SOLE DISCRETION, WHETHER WEBRUS IS RESPONSIBLE FOR ANY SUCH MALFUNCTION OR DISRUPTION. WEBRUS ALSO RESERVES THE RIGHT TO LIMIT YOUR USE OF THE SITE AND/OR THE CONTENT OR TO TERMINATE YOUR ACCOUNT SHOULD WEBRUS DETERMINE THAT YOU HAVE VIOLATED THESE TERMS OF USE, OR THAT YOU HAVE VIOLATED ANY OTHER RULES OR CONDITIONS OF WEBRUS. WEBRUS RESERVES THE RIGHT TO REFUSE ACCESS TO THE SITE AND/OR WEBRUS'S CONTENT, PRODUCTS, AND/OR SERVICES TO ANYONE IN ITS SOLE DISCRETION.     WEBRUS MAY, IN ITS SOLE DISCRETION, REFUND THE INITIAL FEE CHARGED FOR ANY USE OF THE SITE AND/OR ANY CONTENT OR A PRO-RATA PORTION THEREOF CONSISTENT WITH WEBRUS'S REFUND POLICY. WEBRUS SHALL REFUSE ANY REFUND THIRTY (30) DAYS AFTER YOUR PAYMENT FOR USE OF THE SITE AND/OR ANY CONTENT, EITHER PURSUANT TO WEBRUS'S CUSTOMER LICENSE AGREEMENT OR OTHERWISE, REGARDLESS OF THE REASON FOR DISRUPTION.

    IN NO EVENT SHALL WEBRUS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, RELIANCE, OR CONSEQUENTIAL DAMAGES, WHETHER FORESEEABLE OR NOT, INCLUDING, BUT NOT LIMITED TO, DAMAGE OR LOSS OF PROPERTY, EQUIPMENT, INFORMATION, OR DATA, LOSS OF PROFITS, REVENUE OR GOODWILL, COST OF CAPITAL, COST OF REPLACEMENT SERVICES, OR CLAIMS FOR SERVICE INTERRUPTIONS OR TRANSMISSION PROBLEMS, OCCASIONED BY ANY DEFECT IN THE SITE, THE CONTENT, AND/OR RELATED MATERIALS, THE INABILITY TO USE SERVICES PROVIDED HEREUNDER OR ANY OTHER CAUSE WHATSOEVER WITH RESPECT THERETO, REGARDLESS OF THEORY OF LIABILITY. THIS LIMITATION WILL APPLY EVEN IF WEBRUS HAS BEEN ADVISED OR IS AWARE OF THE POSSIBILITY OF SUCH DAMAGES.

    YOU AGREE TO INDEMNIFY AND HOLD WEBRUS AND EACH OF ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS, HARMLESS FROM ANY AND ALL LIABILITIES, CLAIMS, DAMAGES, AND EXPENSES, INCLUDING REASONABLE ATTORNEY’S FEES, ARISING OUT OF OR RELATING TO (I) YOUR BREACH OF THIS AGREEMENT, (II) ANY VIOLATION BY YOU OF LAW OR THE RIGHTS OF ANY THIRD PARTY, (III) ANY MATERIALS, INFORMATION, WORKS AND/OR OTHER CONTENT OF WHATEVER NATURE OR MEDIA THAT YOU POST OR SHARE ON OR THROUGH THE SITE, (IV) YOUR USE OF THE SITE OR ANY SERVICES THAT WEBRUS MAY PROVIDE VIA THE SITE, AND (V) YOUR CONDUCT IN CONNECTION WITH THE SITE OR THE SERVICES OR WITH OTHER USERS OF THE SITE OR THE SERVICES. WEBRUS RESERVES THE RIGHT TO ASSUME THE EXCLUSIVE DEFENSE OF ANY CLAIM FOR WHICH WE ARE ENTITLED TO INDEMNIFICATION UNDER THIS SECTION. IN SUCH EVENT, YOU SHALL PROVIDE WEBRUS WITH SUCH COOPERATION AS IS REASONABLY REQUESTED BY WEBRUS.

    THE PROVISIONS OF THESE TERMS OF USE ARE FOR THE BENEFIT OF WEBRUS, ITS SUBSIDIARIES, AFFILIATES, AND ITS THIRD-PARTY CONTENT PROVIDERS AND LICENSORS, AND EACH SHALL HAVE THE RIGHT TO ASSERT AND ENFORCE SUCH PROVISIONS DIRECTLY OR ON ITS OWN BEHALF.

    THIS AGREEMENT SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEW JERSEY, WITHOUT GIVING EFFECT TO ANY PRINCIPLES OF CONFLICTS OF LAW. YOU FURTHER SUBMIT TO THE EXCLUSIVE JURISDICTION OF THE STATE AND FEDERAL COURTS SITTING IN LOS ANGELES, CALIFORNIA. IF ANY PROVISION OF THIS AGREEMENT SHALL BE UNLAWFUL, VOID, OR FOR ANY REASON UNENFORCEABLE, THEN THAT PROVISION SHALL BE DEEMED SEVERABLE FROM THIS AGREEMENT AND SHALL NOT AFFECT THE VALIDITY AND ENFORCEABILITY OF ANY REMAINING PROVISIONS.
